Alabama Revises Labor Law Poster

Child Labor Laws Poster Updated

Alabama has revised its Child Labor Laws poster to include a new requirement that employers display employment certificates to employ minors aged 14 to 17. The employer must renew the certificates annually.

The mandatory poster states that a Class 1 Certificate is required to employ minors aged 16-17. Minors under 14 years of age may not be employed.

Work permits had been the only required document in the past to hire minors in Alabama.

New information has been added in the "Work Times Restriction" section of the poster for minors under age 19. Federal child labor laws are no longer included in the poster.

A new section of the poster states that no minor employee aged 14 to 15 shall work more than five hours continuously without a documented 30 minute meal or rest period. There is no break law for employees aged 16 and above.

Another new section states that the Alabama Department of Labor has the right to enter, without warrant or notice, any business establishment hiring minors to conduct routine inspections.

The poster also includes a new section regarding the employment of minors in establishments serving alcohol.

Minors aged 14-15 may not work in an establishment where alcoholic beverages are sold, served or dispensed for consumption. Minors 16 years of age and older may be employed in such establishments as busboys, janitors, dishwashers, cooks, hostesses or seaters.

Poster Compliance Center Advises U.S. Employers That New Federal Minimum Wage Poster Is Not a Required Change

2007 Revision of the Federal Minimum Wage Poster "Is Still Valid", According to the DOL Wage & Hour Division Website

A revised federal minimum wage poster has been issued by the U.S. Department of Labor (DOL), dated July 2009. However, the 2007 revision of the federal minimum wage poster "is still valid", according to the DOL Wage & Hour Division website. Our Research Department has also confirmed this information directly with the Wage and Hour Division.

The 2007 federal minimum wage poster is already on our current all-in-one federal poster dated 12/08. It includes all three steps of the minimum wage increase ending with the final increase to $7.25 per hour as of July 24. Employers who have this poster are still in compliance.

The July 2009 revision of the minimum wage poster issued by the U.S. DOL includes only the current federal minimum wage rate of $7.25 per hour effective July 24. There are also changes in the "Enforcement" section of the poster.

According to the Wage and Hour Division website, "every employer of employees subject to the Fair labor Standard Act's minimum wage provisions must post, and keep posted, a notice explaining the Act in a conspicuous place in all of their establishments so as to permit employees to readily read it."
