EQUAL EMPLOYMENT/ GINA CHANGE – NEW FEDERAL LABOR LAW POSTER REQUIRED
October 23rd, 2009The Genetic Information Nondiscrimination Act of 2008 (GINA) was signed into law in May, 2008. However Title II — which protects applicants and employees from genetic discrimination — will finally go into effect Nov. 21, 2009.
The U.S. Equal Employment Opportunity Commission (EEOC) issued a revised “Equal Employment Opportunity Is the Law” poster on Oct. 22, including new information about GINA (Title II). This is a mandatory change for employers with 15 or more employees.
Under GINA, discrimination based on genetic information is prohibited in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral and other aspects of employment.
Employers are also restricted in acquiring and disclosing genetic information.
Changes from the Americans with Disabilities Act Amendments Act of 2008 are also reflected on the new version of the EEO poster.

MAINE UPDATES STATE LABOR LAW POSTERS WITH 3 NEW LAWS
October 16th, 2009Those who find themselves out of work and nursing mothers have been given additional protections now included on a revised labor law poster issued by the Maine Department of Labor.
These changes are found on the Maine Regulation of Employment poster.
A new minimum wage protection for employees has also been added to the Maine Minimum Wage poster, stating that employers may not discriminate against them for discussing their wages with others. An additional update on this poster expands information regarding camp counselors who are exempt from the state’s minimum wage and overtime provisions.
All of these changes are the result of new labor laws that passed in the first session of the Maine legislature covering severance pay, breastfeeding in the workplace and minimum wage topics.
