New Mandatory NLRA Poster & Federal Contractor Exception

Ever since the requirement for the new NLRA poster (National Labor Relations Act) for private employers was issued, there have been questions from some of our customers wondering if they must post this new poster or the similar mandatory NLRA poster for federal contractors that was issued in June 2010.

If you have been wondering about this, here is a quick overview of the 2010 federal contractor NLRA poster requirement:

  • Federal contractors are businesses or organizations who have contracts with the federal government.
  • The NLRA poster for federal contractors (issued by the U.S. Department of Labor) is mandatory for federal contractors or sub-contractors of federal contractors.
  • Exceptions:  The NLRA poster requirement for federal contractors does not apply to federal contracts under $100,000 or sub-contracts under $10,000.

Federal contractors who have been required since June 2010 to post the NLRA federal contractor poster do not need to post the new NLRA poster for private employers.

New All-in-One Federal Labor Law Poster for Federal Contractors

Now that the long-anticipated NLRA poster for federal contractors has been issued by the U.S. Department of Labor, Poster Compliance Center has created a new all-in-one Federal Contractor Poster to make it simple for federal contractors to meet their labor law poster requirements.

All of the posters on our all-in-one Federal Contractor Poster are mandatory for federal contractors (businesses or organizations with federal contracts) as defined below:

  • National Labor Relations Act (NLRA): Required for prime contracts over $100,000 or subcontracts above $10,000
  • SCA/Walsh-Healey: This poster is required under both of these Acts.
    • ·        Service Contract Act (SCA) applies to every contractor or subcontractor with a federal contract in excess of $2,500 for furnishing services in the U.S. through the use of service employees.
    • ·        Walsh-Healey Public Contracts Act (PCA) applies to federal contracts over $10,000 for the manufacturing or furnishing of materials, supplies, articles and equipment.
  • Davis-Bacon: Required for contractors and subcontractors performing work on federal construction contracts in excess of $2,000
  • Workers with Disabilities/Special Minimum Wages: Required for every employer having workers employed under special minimum wage certificatesauthorized by the FLSA, the Service Contract Act and/or Walsh-Healey

There may be additional specialized posters that federal contractors are required to post, depending on their industry, sector, location or workforce.

The new Federal Contractor Poster, which will be in stock next week, is available in a laminated version as well as in eco-friendly Go Green.  All versions of the Federal Contractor Poster are $12.50.

We will produce a Spanish version of the all-in-one Federal Contractor Poster as soon as the Department of Labor issues the official Spanish translation of the new NLRA poster.  Federal contractors and subcontractors will be required to post the NLRA poster in the languages spoken by the employees if “a significant portion of the workforce is not proficient in English”.

Since the NLRA “Notice to Employees” poster as well as the other posters on the all-in-one Federal Contractor Poster apply only to federal contractors, these posters will not be added to our federal labor law poster and are not covered by the 1-Year Compliance Protection Plan.

Q & A For New Federal Labor Law Poster About NLRA Rights

Here are the answers to some of the questions you may have about the new NLRA federal labor law poster, “Notice of Employee Rights Under Federal Labor Laws”, which must be posted beginning June 19 by federal contractors and subcontractors.

Q:  Are there any exceptions to the posting requirements?

A: Yes.  The requirements do not apply to prime contracts under $100,000 or subcontracts below $10,000, according to the Department of Labor Fact Sheet.

Q:  Is there a notice requirement in addition to the posting requirement?

A: Yes.  Federal contracts and subcontracts must include a provision requiring federal contractors and subcontractors to post the notice.  This means that the text of the “Notice of Employee Rights” must be inserted into federal contracts and subcontracts.

Q:  Will the employee notice poster be required in languages other than English?

A: Yes.  Contractors and subcontractors will be required to provide the employee notice poster in languages spoken by the employees if “a significant portion of the workforce is not proficient in English”.  These translations will be issued by the Department of Labor at a later date.

New Federal Labor Law Poster for E.O. 13496?

Q:  Has the new labor law poster required for federal contractors under E.O. 13496 been issued yet?

A: Yes.  The new poster required for federal contractors and subcontractors by Executive Order 13496 was issued on May 20, 2010, by the U.S. Department of Labor.

The poster, called “Notice of Employee Rights Under Federal Labor Laws”,  must be posted by June 19.  It informs employees of federal contractors and subcontractors of their rights under the National Labor Relations Act (NLRA) to organize and bargain collectively with their employers and to engage in other protected activity.

E.O. 13496, which was signed by President Obama in January 2009, also revoked a previous federal labor law poster required for federal contractors called the “Beck Poster” regarding employee rights concerning payment of union dues.

Is There a Federal Labor Law Poster For E.O. 13496?

Q:  What is E.O. 13496 and does it require federal contractors to post a new labor law poster? 

A:  Executive Order 13496, which was signed by President Obama on Jan. 30, 2009, requires a new poster for federal contractors but the poster has not been issued yet

E.O. 13496 revoked a previous federal labor law poster required for federal contractors called the “Beck Poster:  Notice of Employee Rights Concerning Payment of Union Dues”.  

The new poster will replace the Beck Poster. 

The title of this poster will most likely be “Notification of Employee Rights Under Federal Labor Law”. It will inform employees of federal contractors of their rights under the National Labor Relations Act (NLRA) regarding union activity and collective bargaining.
