Q&A: Federal Equal Employment Opportunity (EEO) Poster Supplement

Q.  Is there a new change to the federal EEO (Equal Employment Opportunity) poster?  

A.  Yes. The Office of Federal Contract Compliance Programs (OFCCP) issued the mandatory ‘EEO Is the Law’ Poster Supplement, which includes four recent regulatory changes for federal contractors and must be posted with the current federal EEO poster (dated 11/09).

Q.  Do I need to post the EEO Poster Supplement if I’m not a federal contractor?  

A.  No. Only federal contractors must post this required supplement.  

Q.  What are the four new changes to the federal EEO law?  

A.  The changes all apply to federal contractors and include:

  • Sexual orientation and gender identity:   Executive Order (E.O.) 13672 prohibits discrimination based on sexual orientation and gender identity.
  • Pay secrecy (new section):   Prohibits discrimination against employees or applicants who discuss their compensation or the compensation of other employees.
  • Affirmative action for individuals with disabilities:   Changes to Section 503 of the Rehabilitation Act of 1973
  • Affirmative action for protected veterans: Changes to VEVRAA (Vietnam Era Veterans’ Readjustment Assistance Act of 1974) require affirmative action to recruit protected veterans

Q.  Will the federal government update the federal EEO poster with this new information?

A.  Yes. The EEO poster will be updated. However, the publication date has not been announced at this time and we will continue to closely monitor the situation.
