Hawaii Updates OSHA Poster; Third Required Change on HI Labor Law Poster

The latest required change to the Hawaii labor law poster is on the Hawaii Occupational Safety and Health (HIOSH) poster. 

This is the third recent change to the HI labor law poster.  Other recent changes announced previously include Employment Discrimination and Plant Closings.  We are publishing an updated Hawaii poster with all three of these changes.

Changes to the Hawaii OSHA poster were caused by a new law that increased all penalties for violating the HIOSH law by 10 percent.  This includes an increase in the maximum penalty from $70,000 to $77,000 per item, as well as increases for three other types of HIOSH penalties.

North Carolina & Virginia Labor Law Posters Change but Previous Versions OK

A new North Carolina labor law poster and a new Virginia safety poster have been issued, but the previous versions of both required state labor law posters are still valid. 

  • North Carolina:  No update required for Workers Compensation section of NC Department of Labor Workplace Laws poster.  Minor change to information that explains requirement to post the NC Workers Compensation Notice, and revision date changed to 4/11. 
  • VirginiaNo update required for Virginia Safety and Health (VOSH) poster.  Information rewritten in “Recordkeeping” section regarding some exemptions from recordkeeping requirements.  Revision date changed to 4/11.

Iowa, Ohio State Labor Law Posters Change but Previous Versions Still OK

A new Iowa safety poster and an Ohio equal employment poster have been issued, but the previous versions of both required state labor law posters are still valid. 

  • Iowa:  No update required for Job Safety and Health (IOSH).  Poster changes are expanded zip code for federal OSHA regional office and new revision date of 2/11. 
  • OhioNo update required for Equal Employment Opportunity.  Poster changes are removal of governor’s name and new revision date of 1/11.

New Cal OSHA Safety Poster Is Not A Required Change

Although the California Division of Occupational Safety and Health (Cal OSHA) recently issued a new January 2011 version of its labor law poster called “Safety and Health Protection on the Job”, this poster update is not a required change

In fact, we confirmed with the California Department of Industrial Relations that previous editions of this required safety poster may continue to be used, and that the Cal OSHA poster on our current CA labor law poster with a publication date of 8-10 is still in compliance. 

The last two updates to this safety poster (November 2009 and February 2010) were also not required changes. All three poster changes were made to some of the telephone/address listings for the 25-plus Cal OSHA offices listed on the poster. 

Because Poster Compliance Center prides itself on being “the employer’s most reliable resource”, we only notify our customers about the need to update their posters for mandatory changes.  We also inform customers about changes that have occurred but are not mandatory updates. 

Our goal is to ensure that our customers stay in compliance–rather than just trying to sell more posters.

Washington Changes OSHA Labor Law Poster But Previous Version Still OK

You may have heard that a new “Job Safety and Health Law” poster has been issued by the Washington State Department of Labor & Industries (L&I). 

Although the safety poster is a required Washington labor law poster, the new July 2010 revision is not a required change and the previous version of the poster – December 2008 – is still valid

More detail has been added in the “Fatality and Hospitalization” section of the OSHA poster about reporting incidents that require overnight hospitalization.  However, according to Washington State L&I, the clarification “does not impose any new requirements” and therefore is not a mandatory change. 

The December 2008 version of the Washington OSHA poster is included on our current Washington all-in-one state poster with a publication date of 5/10.

Michigan Changes Safety Labor Law Poster But Previous Version OK

Michigan has updated its “New or Revised MSDS” labor law poster but employers are not required to change their posters.

Minor changes on the MSDS  safety poster include the new name of the Michigan Department of Energy, Labor and Economic Growth (DELEG), and a new date of 7-10.  The poster is issued by the Michigan Occupational Safety & Health Administration (MIOSHA), a division of the Michigan DELEG.

California Labor Law Poster Reminder: New OSHA Safety Poster is Not a Required Change

Although the California Division of Occupational Safety and Health (Cal/OSHA) recently issued a new version of its state labor law poster called “Safety and Health Protection on the Job”, this update is not a required change

In fact the listing for this required safety poster on the Cal/OSHA Publications Page, which has a link to the new November 2009 version, includes the following statement:  “Previous edition may be used. 

The “previous edition” referred to is the February 2006 Cal/ OSHA poster.  This poster is included on our current California labor law poster with a publication date of 12-08. 

Although we posted a blog on this topic on March 4th, we feel it is important to emphasize that the February 2006 version of the Cal/OSHA poster is still in compliance since other poster companies have issued numerous news releases stating that California employers must update their state labor law poster.

New California OSHA Poster is Out But Previous Version Still OK

You may have heard that a new California OSHA poster (Occupational Safety and Health ) has been issued by Cal/OSHA. 

Although Cal/ OSHA’s “Safety and Health Protection on the Job” is a required state labor law poster, the new November 2009 revision is not a required change.  In fact the California Division of Occupational Safety and Health (DOSH) website states that the “previous edition (February 2006) may still be used”. 

Issuing a revised poster while still accepting the previous version as valid is not a common occurrence, but it has happened before.  For example, December 2006 is the latest version of the federal OSHA poster but the U.S. Department of Labor website states “previous versions acceptable”. 

The Cal/ OSHA safety poster explains the basic requirements and procedures for compliance with the state’s job safety and health laws and regulations.  The new version of the state OSHA poster has been updated with some minor changes in the contact information (which includes over 20 office contacts).

Iowa Job Safety and Health, Minimum Wage Posters Updated

The Iowa Job Safety and Health poster has been rewritten with new information for both employers and employees, while the state’s Minimum Wage poster has been updated with specific dollar amounts for certain types of employment

The mandatory Job Safety and Health poster issued by Iowa Workforce Development now states that employees have the right to copies of their medical records or records of their exposure to toxic and harmful substances and conditions.

In addition, the revised Iowa labor law poster states that employers must post any OSHA citations for at least three working days and must certify that hazards specified on an OSHA citation have been reduced or eliminated.

A new phone number for reporting workplace fatalities and catastrophes has been added to the poster.

The updated poster also states that employers may obtain free assistance from Iowa OSHA Consultation in identifying and correcting hazards or for complying with standards, without citation or penalty, by contacting the Iowa Division of Labor.

All specific information from the previous Safety and Health poster about penalties for violations, including dollar amounts, has been deleted. Contact information for both the Iowa Division of Labor Services and the U.S. Department of Labor has been changed on the revised poster.

The updated Minimum Wage poster now states that employers may pay an initial employment rate of $6.35 per hour for the first 90 calendar days of employment. The previous poster said only “less than the minimum wage” for this period and did not give a dollar amount.

The state labor law poster has also been revised to state that the employer’s share for tipped employees must be at least $4.35 per hour instead of the percentage rate (40 percent of the applicable minimum wage) that was on the previous poster.

Expanded Notification Requirements Included in Revised Washington Labor Law Poster

A revised mandatory Washington labor law poster, Job Safety and Health Protection, includes a new requirement that employer report any fatality, probable fatality or incident that results in one or more workers being hospitalized.

That report must be made to the Washington State Department of Labor & Industries Division of Occupational Safety and Health within eight hours of any fatality or incident that results in an employee being hospitalized.

The previous Job Safety and Health Protection notice stated that employers were required to report fatalities or incidents that resulted in two or more workers being hospitalized.

A Labor & Industries website has also been added to the notice for anyone needing more information about the department.
