Effective January 1, 2020, the minimum wage rate in Daly City will increase to $13.75 per hour.
Daly City Minimum Wage Requirements
The updated minimum wage rate of $13.75 per hour applies to all businesses within the geographic boundaries of Daly City and to adult and minor employees who work at least 2 hours or more per week in the city.
Retaliation Protections for Employees
Under Daly City’s Minimum Wage Ordinance, employees who assert their rights to receive the city’s minimum wage are protected from retaliation. Employees have the right to file a civil lawsuit against an employer for any violation of the ordinance, or they may choose to file a complaint with the city.
The city is responsible for investigating possible violations and must have access to payroll records. In addition, the city will enforce violations of the Minimum Wage Ordinance by ordering reinstatement of employees and payment of back wages unlawfully withheld and penalties.
Posting & Written Notice Requirements
In addition to posting the 2020 Minimum Wage notice in a conspicuous place where it can be read easily, Daly City’s Minimum Wage Ordinance requires employers to provide all current employees, and all new employees at the time of hire, written notice of their rights under the ordinance.
While Daly City’s 2020 Minimum Wage notice is already available, employers must keep the 2019 notice posted in their workplaces through December 31, 2019.
