Annual Health Care Security Update for San Francisco

San Francisco’s Office of Labor Standards Enforcement (OLSE) just released its annual update to the Healthcare Security Ordinance (HCSO) notice. Shiny new San Francisco posters will soon be heading out to businesses in the City by the Bay.

Changes to Health Care Security Ordinance

The 2019 HCSO notice states that businesses with a total of 20 or more workers worldwide (formerly employees) and nonprofit organizations with 50 or more workers worldwide are required to spend a minimum amount on health care benefits for each of their covered employees. As on the previous notice, “covered employees” are those who have been employed for more than 90 days and work 8 hours or more per week in the City of San Francisco.  

Here are the minimum amounts employers must spend on health care benefits for each covered employee in 2019:

  • Employers with 20–99 workers must spend at least $1.95 per payable hour.
  • Employers with 100 or more workers must spend at least $2.93 per payable hour.

As we reported last year, payable hours are defined as those for which an employee is paid wages and those for which an employee is entitled to be paid, such as sick leave, parental leave, vacations, and public holidays.

Future Change for San Francisco

As of this writing, there are no changes to the notices for the rest of San Francisco’s workplace ordinances: Family-Friendly Workplace, Paid Parental Leave, Paid Sick Leave, Fair Chance, Consideration of Salary History, and Minimum Wage. However, the city’s first annual minimum wage adjustment will occur on July 1, 2019. We’ll be watching closely for information on the new wage rate and, of course, the updated notice.
