Legal appeals are still pending in two cases filed over the National Labor Relations Act (NLRA) poster requirement. The cases are in the U.S. Court of Appeals for Washington D.C. and the Court of Appeals for the U.S. District Court in South Carolina.
The NLRA poster requirement from the National Labor Relations Board (NLRB) was postponed in April 2012 with an injunction issued by the U.S. Court of Appeals for D.C., pending resolution of the legal appeals.
Oral arguments were heard September 11th in the D.C. appeals court and the opening brief was filed September 29th in the South Carolina appeal, but it is not known when a final decision will be issued.
Poster Compliance Center will continue to closely monitor the situation and advise employers of any significant future developments.
