Minimum Wage Increase for City of Milpitas, CA

Effective July 1, 2018, employers who are subject to the Milpitas business license requirement or maintain a business facility in Milpitas must pay their employees a new minimum wage rate of $13.50 per hour. This increase comes just 6 months after the prior increase to $12.00 on January 1, 2018.

Details of the Milpitas Minimum Wage Ordinance

The Milpitas City Council adopted a Minimum Wage Ordinance in February of 2017. Starting with an increase to $11.00 on July 1, 2017, the city’s minimum wage has been on a path to $15.00, which will occur on July 1, 2019. On July 1, 2020, and each year thereafter, the minimum wage will be adjusted based on the Bay Area Consumer Price Index.

Employees’ Rights

In addition to the Minimum Wage notice, the City of Milpitas has a Know Your Rights notice, which describes the following protections for employees:

  • Employees who work 2 or more hours per week are entitled to receive a minimum wage of $13.50 per hour.
  • Employers may not discriminate or take adverse action against employees who exercise their rights under the law.
  • Covered employees are entitled to these rights regardless of their immigration status.

The notice also provides detailed information for employees on how to file wage complaints with the city, which are free and confidential.
