Multiple Federal Poster Changes Coming Soon

The U.S. Department of Labor (DOL) has issued several new laws which will cause multiple mandatory changes to our federal poster over the next few months.

New OSHA Retaliation Rules

A new OSHA recordkeeping and reporting rule for workplace injuries and illnesses includes retaliation protection rules which employers are required to notify their employees about.

7/14/16 UPDATE:   The DOL just delayed the enforcement date for the retaliation provisions from Aug. 10 to Nov. 1.

One of the ways employers can meet this notification requirement is to post the April 2015 version of the OSHA poster (previously updated but not required), according to the DOL. We will update this poster on our federal labor law poster at the same time the following updates occur.

 New DOL Penalty Increases

The DOL has informed us that these posters will be updated by mid-September.

  • Minimum Wage (FLSA): Penalties for violations of this law will increase effective Aug. 1, 2016.
  • Employee Polygraph Protection: Penalties for violations of this law will increase effective Aug. 1, 2016

Other possible federal poster changes:

  • OSHA (increased penalties) and FMLA (increased penalties): Although these laws go into effect Aug. 1, it is not known if updated posters will be issued because current posters do not include penalty amounts.

We will publish a new federal poster with these changes as soon as the DOL updates the posters.
