New Federal FMLA Poster Expands Military Family Leave; Final Rule Effective Mar. 8

Military family leave coverage was expanded under the Final Rule for the federal Family and Medical Leave Act (FMLA) issued by the U.S. Department of Labor, which goes into effect March 8, 2013.

The new required FMLA poster reflects additional coverage in two areas of military family leave:

  • Military caregiver leave:   Expanded to include family members of covered veterans with a serious injury or illness.  Covered veterans are those who were released or discharged under conditions other than dishonorable at any time during the five-year period before the start of an FMLA leave.
  • Qualifying exigency leave:   Expanded to cover family members of Regular Armed Forces, in addition to National Guard and Reserves.

The federal FMLA poster is required for all covered employers, which means those with 50 or more employees.   Public agencies and public and private elementary and secondary schools are also covered regardless of the number of employees.
