New Jersey has extensive state labor law poster requirements that employers must follow.

 

Federal Labor Law Posters Required in New Jersey

New Jersey employers are required to post the following federal labor law posters:

 

  • Equal Employment Opportunity Is the Law Poster
  • Federal Minimum Wage Poster
  • Family and Medical Leave Act (FMLA) Poster
  • Occupational Safety and Health Administration (OSHA) Job Safety and Health Poster
  • Employee Polygraph Protection Act Poster
  • Uniformed Services Employment and Reemployment Rights Act (USERRA) Poster

 

New Jersey-Specific Labor Law Posters

In addition to the federal labor law posters, New Jersey employers are also required to post the following mandatory state labor law posters. They must be displayed in a conspicuous and accessible place. Businesses that fail to post these notifications may be subject to penalties or fines.

    1. Wage and Hour Abstract Poster: This poster details employees’ rights to be paid minimum wage and overtime wages under New Jersey law. The current minimum wage in New Jersey is $11.00 per hour for most employers; the minimum wage increases yearly. Currently, seasonal and small employers with fewer than six employees must pay a minimum wage of $10.30 per hour. Tipped employees must earn $3.13 per hour; the cash wage plus tips must equal the minimum wage.
    2. Payment of Wages Poster. New Jersey employers must notify their employees of their scheduled paydays, which must occur at least twice a calendar month, with the exception of executive and supervisory employees, who must be paid at least once a month.
    3. Child Labor Law Abstract Poster: This poster summarizes the requirements for employers of minors under 18 years old. The abstract contains a list of prohibitions, limiting minors’ occupations, types of work, and places of work. The poster also details hour restrictions, break requirements, and recordkeeping rules.
    4. Schedule of Hours of Minors Poster: Employers who employ minors under 18 must post the following information: the names of minors under 18, schedule of hours, maximum daily and weekly hours permitted, daily in and out times, and meal period in and out times.
    5. Employer Obligation to Maintain and Report Records Poster: New Jersey employers must maintain and report wage and hour records for each of its employees. This poster details the recordkeeping and reporting requirements for employers.
    6. Unemployment Compensation and Temporary Disability Poster: This poster outlines the benefits payable to workers who are totally or partially unemployed. It also outlines the benefits payable to New Jersey workers who are temporarily disabled due to a non-work-related illness, injury, or other medical condition.
    7. New Jersey Family Leave Act Poster: New Jersey law entitles certain employees to take up to 12 weeks of family leave in a 24-month period without losing their jobs. This poster sets forth eligibility requirements and the notice provisions for taking family leave.
    8. Family Leave Insurance Poster: Currently, New Jersey law provides up to 6 weeks of family leave insurance benefits. This will increase to up to 12 weeks of continuous family leave or 56 days of intermittent leave beginning July 1, 2020. This poster explains how New Jersey workers can file for family leave insurance benefits and who pays for these benefits.
    9. Discrimination in Employment Poster: New Jersey law prohibits discrimination in employment. This poster details the basis and provisions for anti-discrimination protections as well as the contact information for the New Jersey Division on Civil Rights.
    10. Conscientious Employee Protection Act (CEPA) or “Whistleblower Act” Poster: This poster provides information about the legal prohibitions against an employer taking retaliatory actions or creating negative workplace conditions for an employee who reports or refuses to engage in unlawful activities. This poster provides contact information that employees can use to report potential violations of federal or state laws, regulations, or rules.
    11. New Jersey SAFE Act Poster: The New Jersey Security and Financial Empowerment (SAFE) Act allows victims of trauma certain employment protections. Under the law, certain employees may be allowed 20 days of unpaid leave within 12 months to receive care for and attend to the aftermath of domestic or sexual violence, whether it was experienced directly or by a child, parent, spouse, domestic partner, or civil union partner. This poster outlines eligibility requirements for NJ SAFE Act leave.
    12. Gender Equity Poster: This poster outlines the federal and state laws prohibiting employers from discriminating against individuals regarding their compensation, benefits, or terms, conditions, or privileges of employment because of their sex.
    13. New Jersey Earned Sick Leave Poster: Under New Jersey law, most employees have a right to accrue up to 40 hours of earned sick leave per year. This poster details employees’ rights and responsibilities for accruing and using earned sick leave. Employers cannot retaliate against employees for using earned sick leave.
    14. Discrimination in Public Accommodation Poster. New Jersey law prohibits discrimination in places of public accommodation. Restaurants and bars, hotels, hospitals, doctor’s offices, retail stores, auditoriums, libraries, shopping centers, amusement parks, public schools, colleges and universities, gymnasiums, movie theaters, and camps must display this poster.
    15. Discrimination in Housing. New Jersey law prohibits housing discrimination. This poster must be displayed by real estate agencies or brokers, property management offices, and landlords.
