Q&A: New Jersey Gender Equity Poster Delay

Q:   Is it true that the new NJ Gender Equity labor law poster does not need to be posted or distributed by the Nov. 19, 2012, effective date?   Which employers are covered by this law?

A:   According to the New Jersey Department of Labor and Workforce Development:

  • The law does not require that the notification be posted or distributed on the Nov. 19, 2012 effective date.
  • The law does not require that the notification be posted or distributed within 30 days of the Nov. 19, 2012 effective date.
  • The law requires that “every employer in New Jersey, with 50 or more employees,” must post and distribute notification of the law.

The NJDOL explains that the posting and distribution requirements are not triggered until a final version of the notification is published in the New Jersey Register following a regulatory process which takes months.
