The Scoop on the E-Verify Poster – Employer Guidelines

If you have hired an employee in recent years, we know you’re already familiar with posting the required labor law posters. However, chances are you’re also familiar with E-Verify –an online resource managed by the U.S. Citizenship and Immigration Services (USCIS) to allow employers to verify the employment eligibility of new hires.

The USCIS says more than 500,000 employers are enrolled in E-Verify all across the United States and we see the number of states that now require its use increasing year by year. If your state has an E-Verify law, covered employers are required to go through a registration process through the U.S. Department of Homeland Security (DHS) and must post the required participation posters.

Where do I get E-Verify Participation Posters?

As the labor law poster compliance experts, we get this question often.

It’s important to remember that E-verify posters are not the same as labor law posters which are required to be posted by all general employers.

  • Only employers who have registered should post the required participation posters.
  • The posters are a free download during registration. Simply print and post.

There are many labor law poster companies that will sell you the E-Verify participation posters, some even include this poster on the labor law posters you buy. This is incorrect for the following reasons:

  • If it’s included on the labor law posters you’ve purchased and you have not registered with the DHS, then you should not post this participation poster.
  • Most importantly, DHS prohibits commercial sale of these posters by third parties.
