The City of San Francisco just released updates to two of its labor law notices, effective January 1, 2018, which means a new San Francisco poster will soon be on its way to our clients.
Labor Law Updates in the City by the Bay
Health Care Security Ordinance
As per the previous notice, businesses with 20 or more employees (50 or more employees for nonprofit organizations) are required to spend a minimum amount on health care benefits for each of their covered employees. “Covered employees” are those who have been employed for more than 90 days and work 8 hours or more per week in San Francisco.
The minimum amounts that employers are required to spend on health care coverage for employees in 2018 are as follows:
- Employers with 20–99 employees must spend at least $1.89 per payable hour for each covered employee.
- Employers with 100 or more employees must spend at least $2.83 per payable hour for each covered employee.
Payable hours are those for which an employee is paid wages, as well as hours for which an employee is entitled to be paid; for example, sick time, vacations, public holidays, and parental leave.
Paid Parental Leave Ordinance
As of January 1, 2018, the Paid Parental Leave (PPL) law applies to all employers with 20 or more employees worldwide.
Employees who take time off from work to bond with a new child may be eligible for San Francisco PPL supplemental compensation from their employer, in addition to their weekly benefit from the California Paid Family Leave (CA PFL) program.
To be eligible for San Francisco Paid Parental Leave, employees must:
- Be employed for 6 months prior to taking bonding leave
- Work a minimum of 8 hours per week, 40% of the time in San Francisco
- Be receiving CA PFL benefits to bond with their new child
The updated notice states that California Paid Family Leave benefits are now 60% or 70% of employees’ weekly wages.
