Nursing Mother’s Accommodation Act

  • Under the new law, effective July 1, 2017, employers must provide nursing mothers who have a child under 1 year of age with a reasonable break time, with or without compensation, to express breast milk.
  • Employers must also provide nursing mothers with a place to express milk, other than a bathroom, that is reasonably clean and protected from the view of and intrusion by others.

 

Domestic Violence Victims Bulletin

  • New law, effective January 1, 2018, provides employees who have been a victim of an act of domestic violence, who have worked for 90 days, with up to 160 hours of paid or unpaid leave in a 12-month period.
  • Leave may be used for an employee’s own or a family/household member’s health care and participation in court proceedings, as well as for establishing a safety plan related to an act of domestic violence.

 

Pregnant Workers’ Fairness Act

  • New law, effective October 1, 2017, gives employees the right to be free from discriminatory or unlawful employment practices based on pregnancy, childbirth, or a related medical condition.
  • It is unlawful for employers to deny a reasonable accommodation to female employees and applicants, upon request, for a condition related to pregnancy, childbirth, or a related medical condition, unless this would pose an undue hardship on the employer’s business.
  • An employer may not take adverse actions against a female employee for requesting a reasonable accommodation.
  • An employer may require a female employee to submit written medical certification from the employee’s physician to substantiate the need for an accommodation.
