Q: What about State OSHA compliance posters?

A: Twenty-one states have an OSHA-approved State Plan and have required OSHA compliance posters, sometimes called the ‘Safety and Health’ compliance poster. Here are some of the changes that have occurred to OSHA compliance posters in 2015:

  • Alaska had a mandatory change to the AKOSH compliance poster stating that federal OSHA has jurisdiction over private employment only. This required update took effect in January of 2015.
  • North Carolina updated its OSHA compliance poster on the ‘Accident and Fatality Reporting’ section (previously called ‘Reporting Accidents’) for work-related incidents, as well as its ‘Penalties’ section about injuries to persons under 18. This required change took effect in January of 2015.

Q: Are any other changes to the federal labor law posters happening soon?

  • Minimum wage/FLSA compliance poster regarding overtime exemptions
    • President Obama signed the Presidential Memorandum in March 2014 and ordered the DOL to reduce exemptions to federal overtime rules.
    • Final regulations may possibly be released by Summer 2015
  • EEO Poster (federal contractors section)
    • Sexual orientation and gender identity: Effective April 9, 2015
    • Affirmative Action: Effective March 24, 2014 (regulations already in effect)
    • Pay transparency: (no effective date yet)
    • As of April 2015, the OFCCP is discussing compliance poster changes covering these 3 new regulations in this section with EEOC. The OFCCP is working on a supplement compliance poster.
