The Genetic Information Nondiscrimination Act of 2008 (GINA) was signed into law in May, 2008.  However Title II — which protects applicants and employees from genetic discrimination — will finally go into effect Nov. 21, 2009.

The U.S. Equal Employment Opportunity Commission (EEOC) issued a revised “Equal Employment Opportunity Is the Law” poster on Oct. 22, including new information about GINA (Title II).  This is a mandatory change for employers with 15 or more employees.

Under GINA, discrimination based on genetic information is prohibited in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral and other aspects of employment.

Employers are also restricted in acquiring and disclosing genetic information.

Changes from the Americans with Disabilities Act Amendments Act of 2008 are also reflected on the new version of the EEO poster.
