Child Labor Law Requirements in New Jersey

New Jersey’s Department of Labor and Workforce Development recently updated the Child Labor Law Abstract notice with new requirements for certain working minors. While the notice was issued in August, it has a publication date of 7/19.

Updates to Labor Law for Minors

Federal Minimum Wage Requirement

The notice now states that New Jersey employers who are subject to the Fair Labor Standards Act (FLSA) must pay the federal minimum wage of $7.25 to minors who are not covered by a wage order.

New Working Hours for Minors

The working hours for minors ages 16 and 17 who are engaged in street trades have changed. These minors are not permitted to work before 7:00 a.m. or after 7:00 p.m., which is a reduction in hours. Previously, they weren’t allowed to work before 6:00 a.m. or after 11:00 p.m. For those who might not know, street trades include selling, soliciting, collecting, displaying, and distributing merchandise, posters, newspapers, or magazines on any street or in any other public place.

What Else Is New?

In addition to new child labor law requirements, the Child Labor Law Abstract notice has undergone a substantial reorganization and rewording of content, particularly in the “General Information” and “Work Prohibited to Minors” sections. Plus, section headings have been added throughout, which break up the content and make the notice much easier for employers and employees to read.
