Private employers don’t need to worry about the return of the National Labor Relations Board poster requirement because the NLRB decided not to appeal to the U.S. Supreme Court.

This brings to a close several years of legal battles with business groups.  Last year the NLRB lost cases in two federal appeals courts (D.C. and the Fourth Circuit) and an appeal to the Supreme Court was its last resort.

The NLRB poster rule would have required employers to post an 11” x 17” labor law poster notifying employees of their rights under the National Labor Relations Act (NLRA).

However, federal contractors must continue to post a similar NLRA poster from the U.S. Department of Labor because it is required under an Executive Order.
