Does your business need labor law posters to inform employees of their rights and responsibilities under federal and state employment laws and comply with regulations? If you operate as a limited liability company (LLC), you may or may not have to place these posters in your workplace.
When Does an LLC Need Labor Law Posters?
An LLC is a nimble, flexible business entity offering numerous benefits to the owners, such as easy and inexpensive formation, the ability to shield personal assets from business debts and pass-through taxation.
While LLCs also have fewer compliance requirements than corporations, this advantage doesn’t necessarily apply to the placement of labor law posters. If you’re like many of these entities and operate as a one-person organization, you don’t need posters in your workplace. However, if you have one employee or more, you must place posters in your establishment, even if you only employ part-time workers.
Appropriate Poster Information
In most cases, we recommend placing federal and state labor law posters in your establishment. They should include the following information:
- Minimum wage and overtime requirements
- Equal Employment Opportunity Commission (EEOC) information regarding the prohibition of discriminatory practices based on race, religion, disability, age, skin color, gender and national origin
- Employee rights regarding workplace safety as mandated by the Occupational Safety and Health Administration (OSHA)
- Eligibility criteria for unpaid leave under the Family and Medical Leave Act (FMLA)
- Protections afforded to military members under the Uniformed Services Employment and Reemployment Rights Act (USERRA)
- State-specific labor law guidelines
Where Should You Place the Posters?
You must install the posters in a prominent spot in your workplace to ensure maximum visibility and frequent exposure. Examples of acceptable locations include employee entrances, break or lunch rooms and common areas where workers congregate.
What Happens If You Don’t Comply?
Failing to place posters can have significant ramifications for an LLC. Potential consequences include fines or other penalties levied by the relevant labor agencies. You should also review and update your posters periodically to ensure they contain current information regarding the frequently changing labor laws.
