Earned Sick Time Act
The notice now defines a small business as a business with 10 or fewer employees. (Previously, the notice defined a small business as one with fewer than 10 employees.) Businesses with 10 employees are now considered small businesses, and now have to give employees 40 hours of paid sick time per year, with 32 hours of unpaid sick time if more than 40 hours are accrued.
The notice now states that newly hired employees may be subject to a 120-day wait period to use Earned Sick Time.
The section on Complaint Filing has been shortened and the text no longer differentiates between filing a claim with the department and bringing a civil action against an employer. The section now states that an employee affected by an alleged violation may file a complaint with the state's Wage & Hour division.
The notice is available in English and Spanish.
