Family and Medical Leave Act (FMLA) (Feb 2013)
(for employers of 50 or more)

  • Members of both the National Guard and Reserves and the Regular Armed Forces are now covered for qualifying exigency leave.
  • Definition of “covered service member” for caregiving leave is expanded to include “covered veterans” who are undergoing medical treatment, recuperation or therapy for a serious injury.
  • “Covered veteran” is an individual who was discharged or released under conditions other than dishonorable at any time during the five-year period before the start of an FMLA leave for caregiving.
  • New clarification for FMLA definitions of “serious injury or illness” and “serious health condition”
  • New Revision Date of February 2013

This Final Rule is effective March 8, 2013.
