Employees in Menlo Park, California, will soon be getting a minimum wage increase due to the city’s new ordinance.
Effective January 1, 2020, almost all employers in Menlo Park must pay employees who work more than 2 hours per week a minimum wage of $15.00 per hour. However, federal, state, county, and public school district employers are exempt from the requirements of the ordinance.
On January 1, 2021, and each January thereafter, the city’s minimum wage will be adjusted for inflation based on the Consumer Price Index.
Unlike ordinances in several other California cities, Menlo Park’s Minimum Wage Ordinance does not include a phased-in implementation based on the number of employees a business has.
As described on the Minimum Wage notice, the city will take enforcement action to make sure employers are in compliance with the new law. For example, the city might issue an administrative citation with a daily fine for each day an employer is in violation of the ordinance, or it might issue an administrative compliance order.
Menlo Park employers are prohibited from discriminating against or taking adverse action against employees who exercise their rights under the local Minimum Wage Ordinance. Employees have the right to file a complaint about any business that is not in compliance with the local minimum wage rules. In addition, employees have the right to inform other employees about their rights and assist them if needed.
Employees should contact the City Manager’s Office to report a violation of the ordinance or get additional information. The Minimum Wage notice includes a link to Menlo Park’s minimum wage page, which provides important information for both employers and employees.
