The New Minimum Wage for Oakland
Effective January 1, 2020, employers in Oakland, CA must pay a minimum wage of $14.14 per hour to all part-time and full-time employees who perform at least 2 hours of work in one workweek within the geographic limits of the city.
Each January 1, Oakland’s minimum wage is adjusted based on the prior calendar year’s increase, if any, in the Consumer Price Index for urban wage earners and clerical workers in the San Francisco-Oakland-San Jose, CA metropolitan statistical area.
*At this time, there are no changes to Oakland’s Paid Sick Leave notice.
Retaliation Protections for Employees
Under Section 5.92 of Oakland’s Municipal Code, employees who assert their rights to receive the city’s minimum wage are protected from retaliation by their employers.
Oakland employees have the right to file a civil lawsuit against any employer who violates the law and may request remedies such as back pay, reinstatement, and/or injunctive relief. Additionally, employees have the right to file a complaint with the city’s Contracts and Compliance Division. Employers who are found to be in violation of the law are liable for civil penalties up to $1,000.00 per violation.
