A New Law for San Francisco—A New Poster for Your Workplace!

The City of San Francisco just released its new poster, which reflects the new Paid Parental Leave Ordinance and amendments to two existing laws. Read on to find out what’s changing in the City by the Bay!

Details of the Paid Parental Leave Ordinance

The new Paid Parental Leave Ordinance went into effect on January 1, 2017 for large employers. The law provides parents with up to 6 weeks of paid leave to bond with a new child, in addition to their weekly benefit from the California Paid Family Leave Program.

The parental leave benefits begin after 6 months of employment, providing an employee works a minimum of 8 hours per week and 40% of those hours are in San Francisco.

The new law is being phased in as follows:

  • For employers with 50 or more employees, on January 1, 2017.
  • For employers with 35 or more employees, on July 1, 2017.
  • For employers with 20 or more employees, on January 1, 2018.

Amendments to the Paid Sick Leave Ordinance

San Francisco’s Paid Sick Leave Ordinance has been amended to align with California’s Healthy Workplaces/Healthy Families Act. As of January 1, 2017, employers of 10 or more employees must now allow employees to accrue at least 72 hours of paid sick leave. Employers of fewer than 10 employees have a couple of options, and may allow employees to accrue up to at least 48 hours of leave.

Under the revised law, paid sick leave may be used for an employee’s existing health condition or preventive care; for recovery from domestic violence, sexual assault, or stalking; or to care for a family member.

Health Care Security Ordinance Changes

Effective January 1, 2017, the amount employers must spend per hour per employee on health care coverage is going up. According to the Health Care Security Ordinance, employers with 20–99 employees must now spend at least $1.76 per hour of health care coverage for each employee. Employers with 100 or more employees must now spend at least $2.64 per hour of health care coverage for each employee.
