What’s Changing in the Granite State?

After a 2-year hiatus, we have a labor law update for the State of New Hampshire.

We’ve been waiting for the New Hampshire Commission for Human Rights to update the Employment Discrimination notice to include “gender identity”. This change is based on an amendment to the state’s Law Against Discrimination that went into effect on July 8, 2018. Our contact at the Commission assured us that the notice would be updated, and 14 months later, the agency has made good on its word.

Employment Discrimination Protections

We are pleased to report that “gender identity” has at last been added to the list of protected classes on the Employment Discrimination notice. 

However, the term “sexual harassment” has been removed. The Commission explained that while sexual harassment is illegal, it is not considered a state or federally protected class.

Here is the current list of protected classes related to discrimination in employment:

  • Race
  • Color
  • National origin
  • Age
  • Sex
  • Gender identity
  • Sexual orientation
  • Marital status
  • Pregnancy
  • Physical disability
  • Mental disability
  • Religion

New Contact Information

The last two updates to the Employment Discrimination notice are in the contact information area. A new website for the New Hampshire Commission for Human Rights has been provided, and the phone number for the Commission now includes an area code (603-271-2762).
