Heads-up, Montgomery County Employers: New Minimum Wage Law in Effect

Montgomery County’s new Minimum Wage and Overtime Law went into effect on July 1, 2018. Details of the law, which calls for multi-step wage increases based on business size, are outlined below.

New Minimum Wage Rates for Montgomery County

Minimum Wage for Large Employers

For businesses with 51 or more employees, the minimum wage is now $12.25 per hour. Future increases will occur every July 1 until the wage reaches $15.00 on 7/1/21. Thereafter, the minimum wage for large employers will be adjusted annually based on the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W).

Minimum Wage for Mid-Sized Employers

For businesses with 50 or fewer employees, the minimum wage is currently $12.00 per hour. Future increases will occur every July 1 until the wage reaches $15.00 on 7/1/23. Thereafter, the minimum wage for mid-sized employers will be adjusted annually based on the CPI-W, up to 1%, until the wage is equal to the rate for large employers.

Minimum Wage for Small Employers

The Montgomery County Minimum Wage and Overtime Law also provides stepped increases for small employers—those with 10 or fewer employees. However, this information is not provided on the notice because the minimum wage rates for small and mid-sized employers are the same for 2018 & 2019.

Beginning July 1, 2020, the minimum wage for small employers will increase by $.50 each year until it reaches $15.00 on 7/1/24. Thereafter, the small employer minimum wage will be adjusted annually based on the CPI-W, up to 1%, until the wage matches the rate for large employers.
