Labor Law Updates for Hawaii—New Poster Required

Hawaii’s Department of Labor (DOL) just issued a new HIOSH–Safety & Health notice. In addition, an amendment to the state’s Family Leave Law has been added to the Wage & Hour Laws notice. These updated notices will soon appear on our new Hawaii Labor Law Poster, which has a publication date of 1-18.

Labor Law Updates in the Aloha State

HIOSH–Safety & Health

The HIOSH notice, which has a revision date of January 2018 and brand-new design, now includes additional federal OSHA requirements.

Employers must:

  • Report all work-related fatalities within 8 hours
  • Report all inpatient hospitalizations, amputations, and losses of an eye within 24 hours
  • Provide safety & health training to all workers in a language and vocabulary they can understand

The penalty amounts for HIOSH violations have been removed, and new contact information for the Regional Administrator/U.S. Department of Labor has been provided.

The notice states that copies of the state law, the rules and standards, and other program information may be obtained from HIOSH, which now has a single office in Honolulu. There is a new address for this location, and a website has been added for those who wish to find information online: For phone inquiries, there is now just one number to call regardless of an employer’s or employee’s location: 800-586-9100.

Wage and Hour Laws – Family Leave

Last year, Hawaii’s governor signed House Bill 213, which expands the state’s Family Leave Law. The Wage and Hour Laws notice has been updated to reflect this change and has a revision date of 12/15/2017.

In addition to getting up to 4 weeks of unpaid, job-protected Family Leave for the birth or adoption of a child, or to care for a seriously ill child, parent, spouse, or reciprocal beneficiary, employees may now use leave to care for a sibling with a serious health condition.
