Two new federal posters – Minimum Wage and Employee Polygraph Protection – were issued today (July 26) by the U.S. Department of Labor Wage and Hour Division. Both of these posters were updated with mandatory changes regarding civil monetary penalties.
The Department of Labor (DOL) announced that they must be posted by August 1, 2016. We put our federal labor law poster into production immediately and will publish it as soon as possible, although the poster cannot be produced and mailed in only four days.
The third mandatory change on our new federal labor law poster is the April 2015 version of the federal OSHA “It’s the Law” poster. This poster is one way to meet the notification requirement for the retaliation provisions of the new OSHA recordkeeping and reporting rule called Tracking Workplace Injuries and Illnesses. The April 2015 version of the OSHA poster was previously updated but did not meet any posting requirements until now.
Enforcement of the OSHA retaliation provisions was delayed recently from August 10 to November 1.
This is the first time we can remember having more than one change at a time on the federal poster – much less three!
The three posters with mandatory changes were updated based on two new laws. Minimum Wage/Fair Labor Standards Act (FLSA) and Polygraph Protection changes reflect the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. Both posters include new general information about penalties for violations of the law, and out-of-date penalty amounts have been removed.
The federal OSHA poster includes new information about retaliation provisions in the Tracking Workplace Injuries and Illnesses regulations issued by OSHA in May 2016. The regulations require certain employers to electronically submit injury and illness data to OSHA that they are already required to keep under OSHA regulations.
The April 2016 Family and Medical Leave poster (FMLA) will also be updated on our new federal poster but is not a mandatory change.
We are publishing an updated federal labor law poster which includes all of these changes. Our OneSystem customers will automatically receive the new federal labor law poster.
