Just like this time last year, Virginia’s Department of Labor and Industry (DLI) has updated the Job Safety & Health Protection (VOSH) notice, which has a new revision date of August 2019. The updated notice is available in both English and Spanish.
What’s Changing for Safety & Health?
New Penalty Amounts for Employer Violations
The Proposed Penalty section of the VOSH notice has been updated to reflect federal OSHA penalty requirements. Private-sector employers who are in violation of the law may be assessed the following penalty amounts:
- Mandatory penalties of up to $13,047 may be proposed for each serious violation.
- Optional penalties of up to $13,047 may be proposed for each other-than-serious violation.
- Daily penalties of up to $13,047 may be assessed for failure to correct violations within the proposed time period.
- Penalties of up to $130,463 may be assessed for each willful or repeated violation.
Criminal penalties of no more than $70,000 for an employer’s willful violation that results in the death of an employee remain the same.
