Due to updated information on Wyoming’s Health and Safety Protection on the Job (OSHA) notice, our Wyoming customers will need to order new labor law posters for their workplaces. The new Wyoming poster has a revision date of 4/19/18.
What’s Changing on the OSHA Notice?
Serious, Non-Serious, and Willful Violations
Penalty amounts for serious, non-serious, and willful violations have been removed from the notice; however, penalty amounts for willful violations that result in the death of an employee are still available on the notice.
To obtain the penalty amounts that have been removed, employers may call the Wyoming OSHA phone number provided or go to the following website: rules.wyo.gov/Search.aspx?mode=1
Reporting Fatalities and Injuries
The timelines during which employers are required to report all work-related fatalities and inpatient hospitalizations, amputations, and losses of an eye have been moved. They are now located in a more prominent “Employer Reporting Requirements” section on the first page of the notice.
Filing a Complaint
As stated previously on the notice, employees may not be discriminated against or discharged for filing a complaint with Wyoming OSHA or otherwise exercising their rights under the law. However, new information states that for discrimination cases, there is no set number of days during which a citation for a protected activity will be issued.
Technical Assistance
Technical Assistance Consultative Services is now responsible for providing free technical assistance to all employers, associations, and state & local governments working within the boundaries of Wyoming. The services, which include courtesy visits, health & safety training, and consultation, are now available only to employers upon written request. Previously, these services were also available to employees.
No Other Changes for Wyoming
