North Carolina’s Department of Labor (DOL) just updated its Wage and Hour poster, which has a revision date of 11/17. The poster includes a new section, Employee Classification, and an update to the Right-to-Work information. The DOL has also added icons to reflect that people can follow the department on social media.
Changes to Wage and Hour Laws
New Employee Classification Law
Based on the passage of the Employee Fair Classification Act, which goes into effect on 12/31/17, it is unlawful for employees to be misclassified as independent contractors. Any worker who is defined as an employee under the Act must be treated as an employee.
Workers who believe they have been misclassified as independent contractors by their employers may file a complaint with the Employee Classification Section of the North Carolina Industrial Commission. Complaints may be made by phone, email, or fax. Employees need to provide the suspected employer’s location and mailing address, as well as the employer’s phone number and email address, if available.
North Carolina is a right-to-work state, and the N.C. Department of Labor has now provided more information on what that means.
Right-to-work applies to collective bargaining or labor unions. People’s right to work can’t be denied or reduced in any way because they are members of a labor union, or because they choose not to be a member of a labor union.
In addition, the N.C. Department of Labor has no authority to enforce union labor laws. For employees who have concerns related to labor unions, the DOL has provided contact information for the Regional Office of the National Labor Relations Board (NLRB). The NLRB is described as “an independent federal agency that protects the rights of private sector employees to join together, with or without a union, to improve their wages and working conditions.”
